Part One

MOHRE Complaints β€” Ministry of Human Resources

The Ministry of Human Resources and Emiratisation (MOHRE) is the first port of call for most employment disputes in the UAE. This stage has strict timelines, and how your file is presented here has a direct bearing on the final outcome.

Filing your complaint

Electronically via the MOHRE app. Your employer is notified within 24–48 hours of submission.

Mediation stage

14 days for the Ministry to attempt an amicable settlement between the parties. We prepare you and represent you throughout.

Claims not exceeding AED 50,000

MOHRE issues a binding final decision directly, without court proceedings. Fast and enforceable.

Settlement not reached

The case is automatically referred to the competent Labour Court with a Ministry summary and recommendations.

Salary suspension during dispute

The Ministry may oblige your employer to continue salary payments for up to two months during the dispute period.

Part Two

Wrongful Termination in the UAE

Federal Decree-Law No. 33 of 2021 requires a legitimate, documented reason for any termination of employment. A termination is considered wrongful if it is motivated by:

  • βœ—The employee filing a complaint against the employer before MOHRE or the courts
  • βœ—The employee's gender, nationality, religion, race or disability
  • βœ—Pregnancy or maternity leave
  • βœ—Participation in trade union activity or forming an employee committee

⚠ Do not sign any document immediately after termination β€” particularly settlement and release forms. These documents, if signed without scrutiny, can extinguish your full legal rights.
