Our Legal Services in the UAE

For employees and employers β€” full coverage at every stage of the employment relationship, in Arabic, English and Russian.

Part One

Services for Employees

Wrongful Termination

UAE law prohibits termination without a legitimate, documented reason. If you have been dismissed without sufficient grounds, you are entitled to claim compensation of up to three months' full salary in addition to all other legal entitlements.

  • Compensation up to 3 months' full wage (basic + allowances)
  • Notice period pay if not given
  • Accrued annual leave balance paid in cash
  • Full end of service gratuity

⚠ Do not sign any documents at the point of termination β€” particularly settlement and release forms β€” without first consulting a specialist. Signing without scrutiny can extinguish your legal rights entirely.

Unpaid Salary & Financial Entitlements

The Wage Protection System (WPS) requires every UAE employer to pay salaries on time through approved channels. Any delay is a direct violation of the law, and you are entitled to file an immediate official complaint. We recover:

  • All months of overdue salary in full
  • Unpaid overtime and allowances
  • End of service gratuity if forced to resign due to non-payment
  • Court-awarded compensation for demonstrated losses

End of Service Gratuity (EOSB)

End of service gratuity is a statutory right for every employee who completes one continuous year of employment in the UAE. It must be paid within 14 days of the contract ending. We calculate your precise entitlement and pursue your claim β€” including for DIFC and ADGM employees.

  • 21 days' basic salary per year for the first 5 years
  • 30 days' basic salary per year beyond 5 years
  • Capped at two years' total basic salary
  • Must be paid within 14 days of contract end

MOHRE Complaints & Labour Disputes

We manage the complete process: preparing your complaint file, submitting to the Ministry, preparing for mediation, and representing you if the case is referred to the Labour Court. Errors at this first stage have a direct impact on the final outcome.

  • Full file preparation and submission
  • Mediation preparation and representation
  • Claims under AED 50,000 β€” MOHRE issues binding decision directly
  • Court referral and support if settlement not reached

Workplace Discrimination & Harassment

Federal Decree-Law No. 33 of 2021 explicitly prohibits discrimination on grounds of gender, nationality, religion, race or disability, as well as sexual harassment, bullying, and psychological violence in the workplace. We handle these sensitive cases with the highest degree of confidentiality.

Residency Status & Work Permits

We assist with the legal consequences of employment disputes on residency status, work permit validity, and responses to absconding reports β€” helping you protect your legal standing in the UAE through every stage of a dispute.

Part Two

Services for Employers & Businesses

The 2024 amendments raised employer fines to between AED 100,000 and AED 1,000,000 per violation. Proactive legal compliance is always less costly than litigation.

Employment Contract Drafting & Review

Contracts that comply with the Ministry of Human Resources' electronic registration requirements, and that protect your business interests in confidentiality clauses, non-compete provisions, and termination mechanisms.

HR Policies & Employee Handbooks

We prepare UAE-compliant internal policies covering:

  • Disciplinary policy and corrective action procedures
  • Anti-harassment and healthy workplace policy
  • Leave entitlements and working hours framework
  • Remote work policy and UAE compliance

Emiratisation (Nafis) Compliance

We help businesses meet the required Emiratisation quotas, avoid escalating penalties, and implement practical, compliant hiring strategies that work for your sector and size.

Termination Strategy & Workforce Restructuring

A properly documented, legally sound termination is the difference between closing a file cleanly and opening a costly dispute. We handle individual and collective termination strategies and workforce restructuring across all UAE emirates.

Important Warning

5 Common Mistakes After Termination

1

Signing a settlement and release form without legal review

These documents, if signed without scrutiny, can extinguish your full legal rights.

2

Accepting the first settlement offer without knowing your full entitlements

First offers are typically well below the legal entitlement.

3

Waiting too long β€” the two-year limitation period narrows your options

After two years, the right to claim is extinguished by law.

4

Resigning immediately without assessing the impact on your gratuity

The decision to resign must be a considered legal one β€” consult us first.

5

Failing to preserve evidence β€” deleting messages and discarding correspondence

UAE employment disputes are primarily document-based. Start preserving everything immediately.
